Switching Flats in Shanghai Without Losing Your Deposit (2026)

By Choice Essentials Editor · 7 min read · Updated October 2026 · Fact-checked 事实核查 · standards 标准

Moving flats in Shanghai is simple on paper and brutal on cash flow: you pay a new deposit and three months up front before your old deposit comes back.

You can switch flats in Shanghai whenever you like, but the money moves in the wrong order: you pay a new deposit plus three months' rent up front (押一付三) before your old deposit comes back, and usually a fresh agent fee on top. Budget roughly four to five months' rent in cash to make the jump, give notice in writing, and photograph everything on the way out.

The second move is the one nobody warns you about. The first time, you were just relieved to have a roof. By the second lease you know the city, you know you want a different street or a landlord who answers the phone, and you assume moving is easy. If you are still weighing which area, our guide to where to live in Shanghai, sorted by rent, lays out the trade-offs. It is, right up until the cash maths lands. Here is exactly how it works and where the money goes.

Can you move out before your lease is up?

Yes, but almost nothing here is set by national law; it is set by the contract you signed. Read the 退租 (end-tenancy) and 违约 (breach) clauses first. The common shape is a 30-day written notice and, if you leave before the term ends without a break clause, you forfeit your deposit as the penalty. A well-written lease has a 提前退租 clause that lets you leave early for a fixed cost, so if you are the type who moves often, negotiate that in before you sign the next one.

The money trap nobody warns you about

Here is the part that catches people. To take the new place you pay 押一付三, one month as deposit plus three months' rent in advance, before you move a single box. Your old deposit, another month's rent, does not come back until after you have moved out, cleaned up and settled the final bills. For a few weeks you are carrying both. On an ¥8,000 (about USD 1,200) flat that is around ¥32,000 (about USD 4,800) going out before a single yuan comes back.

The deposit from your old flat almost never arrives before you have to pay for the new one.

So the real question is not whether you can afford the new rent, it is whether you have four to five months' rent sitting in cash to bridge the gap. If you do not, line up the timing (below) so the two leases barely overlap, and ask the new agent whether a smaller up-front split, like 押一付二, is on the table. On a direct-landlord deal it sometimes is.

Getting your old deposit back

Deposits go missing on move-out day, not on paper. The landlord inspects, finds a scuff or an unpaid gas bill, and quietly keeps a slice. Protect yourself: settle every utility bill to zero first, do a walk-through with the landlord present, and photograph and video the whole flat, meters included, the day you hand back the keys. Keep the chat records where you reported any pre-existing damage when you moved IN. Normal wear and tear is not a deduction; a burn in the counter is. If a landlord withholds the deposit for something unfair and will not budge, 12345, the citizen hotline, and the neighbourhood 居委会 can mediate, and small claims through the 人民法院 is the backstop. Our guide to getting a Shanghai deposit back without a fight walks through the dispute step by step.

Timing two leases so you do not pay double rent

The cleanest switch overlaps the two tenancies by about a week: enough to move your things, clean the old flat and hand it back, not so long that you pay a full second month of rent on an empty room. Give your old landlord the written notice your contract requires, usually 30 days, the day you are sure of the new place. Do not hand back the old keys until you have the new ones and have checked the new flat works, every tap, the AC, the water heater, the door locks. A week of overlap costs a fraction of a month; being locked out of both places for a weekend costs a hotel and your sanity.

Agent, managed apartment, or direct from the landlord?

How you find the next flat decides how much of that up-front cash is a one-off fee and how much hassle you take on yourself.

Three ways to find your next Shanghai flat
RouteWhat you payThe catch
Agent (中介)30 to 50% of one month's rent, one-offWidest choice, the fee is negotiable, quality varies a lot
Managed apartment (自如 and similar)A service fee, sometimes a monthly-pay planFurnished and transparent, no haggling, but pricier and stricter on pets and changes
Direct from the landlord (房东直租)No agent fee at allCheapest, but you handle the contract, the 发票 and any dispute yourself

If you value your weekends, an agent or a managed brand like 自如 does the legwork. If you value the ¥2,400-plus (about USD 360) you would hand an agent, and you can read a Chinese contract or have someone who can, going direct to the landlord is the cheapest route by a clear margin.

The paperwork that moves with you

A new address is a new registration. Within 24 hours of moving, you must file 境外人员临时住宿登记, temporary accommodation registration, at the local 派出所 (police station) or through the 随申办 app if you are not in a hotel. It is free, it takes minutes, and your next visa or residence-permit renewal will ask for the up-to-date slip, so do not skip it. Then switch the utility accounts and your delivery and bank addresses, and if you hold a 居住证 (residence permit for the city), update the address on that too.

Which one is for you

If you have the cash cushion, move whenever the right flat appears and sort the deposit afterwards.

If money is tight, time the two leases to overlap by a week, ask for a smaller up-front split, and go direct to a landlord to skip the agent fee.

If you move often, negotiate a 提前退租 break clause into your next lease so the next switch costs a fixed fee, not your whole deposit.

常见问题

Can you move out of a Shanghai apartment before the lease ends?

Yes. Give the written notice your contract requires, usually 30 days. But unless your lease has a 提前退租 (early-exit) clause, breaking the term early normally means forfeiting your deposit as the penalty, so read the breach clause before you commit to a new place.

How much deposit do you pay to rent in Shanghai?

The Shanghai norm is 押一付三: one month's rent as the deposit plus three months' rent paid up front, so on an ¥8,000 flat you hand over ¥32,000 (about USD 4,800) on day one. On a direct-landlord deal you can sometimes negotiate down to 押一付二.

Do you actually get your rental deposit back in Shanghai?

You do if the flat is clean and every bill is settled to zero. Landlords deduct for real damage, cleaning or unpaid utilities, so do a walk-through, photograph and video the whole flat and the meters on hand-over day, and settle the bills first. Normal wear is not a valid deduction.

How much is the agent fee for renting in Shanghai?

Usually 30 to 50% of one month's rent, paid once by the tenant, so ¥2,400 to ¥4,000 (about USD 360 to 600) on an ¥8,000 flat. It is negotiable, a few agents charge the tenant nothing and bill only the landlord, so always ask before you view.

Do I have to register with the police when I change address in Shanghai?

Yes. Foreign nationals must file 境外人员临时住宿登记, temporary accommodation registration, within 24 hours of moving, at the local 派出所 or through the 随申办 app. It is free and quick, and your next visa or residence-permit renewal will ask for the current slip.

The 易经 has a line for the fed-up tenant: 穷则变,变则通, when a situation reaches its limit it changes, and in changing it finds a way through. A better flat in Shanghai is often just the first box taped shut.
